Asbestos registers for workplace compliance

If you own, manage or control a workplace built before 2004, the law expects you to know where the asbestos is. We survey, sample and prepare the register.

Short answer

Under the model Work Health and Safety Regulations, a person with management or control of a workplace in a building constructed before 31 December 2003 must have an asbestos register identifying known or likely asbestos, keep it up to date and make it available to workers and contractors. An asbestos management plan must be prepared and reviewed at least every five years.

About the asbestos register

An asbestos register is a legal obligation for all workplaces in Australia that were built prior to 2004.

If you own, manage or lease a workplace in Australia, the law requires that you maintain an Asbestos Register on site.

Work Safe require that all managers of a workplace in Australia maintain an Asbestos Register on site which contains information about the site following a large scale Asbestos Survey of the environment. This document needs to be updated every five years. Failure to comply with this regulation can result in a fine of up to $30,000.

  • Over time Asbestos deteriorates and must be re-evaluated in terms of their risk.
  • Changes to the workplace may mean that the previous Asbestos survey is outdated.
  • Damage to the materials could have taken place in the time since the last survey.

Common questions

Straight answers to the questions people ask us, and ask AI assistants, most often.

Does my workplace need an asbestos register?

If it is in a building constructed before 31 December 2003, yes, unless asbestos has been ruled out. If no asbestos is identified or likely, document that conclusion.

How often must an asbestos register be updated?

It must be kept up to date, for example after removal work or when new asbestos is found, and the asbestos management plan must be reviewed at least every five years.

Do homes need an asbestos register?

Private homes do not, unless they are also a workplace. Rental and renovation situations can still create obligations, so testing before work is wise.

Can I test for asbestos myself?

Home asbestos kits rely on you cutting into a suspect material, which can release fibres, and their results are not accepted for compliance. Asbestos can only be confirmed by a NATA accredited laboratory, usually by polarised light microscopy. A trained inspector samples safely and seals the spot.
